Abstract

The development of technology and information is so rapid that it encourages changes in many aspects of life. The Constitution of the State of Indonesia, in Article 28G Paragraph (1) regulates the right to protection for oneself, family, honor, dignity, and property under its control. The right to privacy and personal data belonging to the public is an important part that must be protected so that people have a sense of security over their lives. In Decision Number 235/Pdt.G/2020/PN.Jkt.Pst where Tokopedia consumers experienced personal data leaks. The purpose of this research is to find out the legal protection of Tokopedia consumers who are victims of personal data leaks and also to find out the responsibilities of Tokopedia to victims and the penalties that apply to third parties. This research method uses normative juridical which uses secondary data as the main data related to the object of research and is analyzed descriptively qualitative. Based on the results of this study, Tokopedia as an Electronic System Operator in the terms and conditions regarding its privacy policy still contains clauses that contain elements of limiting liability and guarantees on its security system. In decision No. 235/Pdt.G/2020/PN.Jkt. KKI as the The plaintiff was not careful in determining which competence to file a lawsuit in connection with the leak of personal data of Tokopedia users, causing the lawsuit to be rejected; then based on the Consumer Protection Law and related laws and regulations, efforts can be made through litigation in the form of a lawsuit through an authorized court and through non-litigation or out-of-court channels. Based on the explanation above, Tokopedia can still be said to not have a security system that is not fully secure, because there are still leaks of consumer personal data that can be misused.
