Abstract
The partnership relationship issues between Gojek drivers and the application provider company lead to digital exploitation. The absence of legal protection for online motorcycle taxi drivers creates an imbalance in the partnership relationship between Gojek drivers and Gojek as the application provider company. This paper focuses on how the Confederation of Indonesian Trade Unions (KSPI) serves as a platform that can accommodate the interests of Gojek drivers in advocating for their rights. The method used in this research is descriptive qualitative, employing a literature study approach and interview techniques as primary data sources to investigate a social phenomenon or reality. This research aims to delve into the industrial relations conflict experienced by Gojek drivers from the perspective of the response and role of trade/labor unions and to provide a basis for labor unions in assisting online motorcycle taxi drivers by pressuring the Ministry of Manpower to create regulations focused on online motorcycle taxi drivers. The results of this research indicate that the main factor causing conflict and digital exploitation of Gojek drivers is the government's lack of decisiveness in creating legal products that specifically regulate Gojek drivers. The advocacy efforts undertaken by KSPI, which include strategies in Education, Cooperation, Litigation, and Contestation, have not yet felt significantly impactful due to ongoing advocacy for the formation of policies for online motorcycle taxi drivers up to May Day 2024. However, KSPI's success in advocating for the rights of Gojek drivers has been commendable in terms of strengthening organizational power, civil society, and democratic space.
