Abstract
This research was written to discuss the auction winner whose rights have not been fulfilled regarding the execution of the auction object in decision Number 517/Pdt.G/2017/PN.BDG.'s rights have not been fulfilled because the object owner has not handed over the auction object to the auction winner, even though the implementation of the execution of the mortgage right auction has fulfilled the requirements for conducting an auction. In this study, the problem is legal protection for the winner of the mortgage object auction case and the role of the government, in this case, the District Court as the agency authorized to provide legal certainty. The method used is normative juridical and the type of approach used is legislation and case approach. The result of this study is legal protection for the auction winner, in the form of a vacancy decree issued by a District Court judge. The rights of the auction winner have not been protected because the auction owner has not emptied the auction object even though all the auction requirements have been met the requirements. The resolution of this problem is contained in SEMA No. 4 2014, the auction winner can directly ask for a vacancy decision letter from the Bandung Court Chief without going through a lawsuit.
