Abstract

In Indonesia, a song or piece of music can be considered a complete work of copyright. Both songs and music are subject to the same rules as other works of copyright, unless otherwise specified. Copyright for songs in Indonesia is regulated by Law Number 28 of 2014 concerning Copyright. This study aims to analyze forms of song copyright infringement through digital platforms from the perspective of Indonesian and Malaysian law and to compare the copyright legal protection systems in Indonesia and Malaysia. In Malaysia, anyone who uses copyrighted works without permission from the creator, rights owner, or performer is subject to infringement under the Copyright Act 1987. The Lagu Kanak TV account uploaded the song "Helo Kuala Lumpur" with lyrics adapted to Malaysian. However, the song uses the exact same tune as the song "Halo-Halo Bandung" by Ismail Marzuki. This violates Law Number 28 of 2014 concerning Copyright. The research method used is yuridis normative research, a legal research method that gathers information from various sources such as books, journals, and relevant regulations. The research results show that Malaysia violated Article 5 and Article 9 of Law Number 28 of 2014 concerning Copyright. The Copyright Law in Indonesia provides privileges to copyright owners as well as legal and administrative sanctions for anyone who violates copyright as legal protection.
