Abstract

Indonesian Migrant Workers (PMIs) frequently face complex protection challenges in Malaysia, particularly due to Malaysia’s non-ratification of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICRMW), which has created a normative gap contributing to the rise of non-procedural migration. This study aims to analyze Indonesia’s foreign policy in protecting Indonesian migrant workers in Malaysia through the translation of the ICRMW as a normative foundation into an adaptive foreign policy approach and its operationalization through the 2022 Memorandum of Understanding (MoU). Employing a qualitative approach and a case study method, this research is grounded in Rosenau’s Adaptive Foreign Policy theory and the concept of Indonesian Migrant Workers within the ICRMW framework. The findings reveal that Indonesia’s protection diplomacy during the 2022–2024 period evolved toward more operational practices; however, it shifted from a promotive to a more pragmatic acquiescent approach and continued to face challenges related to institutional coordination and the protection of non-procedural migrant workers. Therefore, strengthening the One Channel System (OCS), integrating inter-agency data systems, refining the 2022 MoU, and enhancing a more inclusive bilateral diplomacy are necessary to improve the protection of Indonesian migrant workers.
