Abstract
The advancement of information technology has transformed conventional gambling into online gambling, which is characterized by more complex, structured, and organized criminal activities. In practice, inconsistencies remain in the application of criminal law to online gambling offenders, particularly between the provisions of the Indonesian Criminal Code (KUHP) and the Law on Electronic Information and Transactions (ITE Law). These inconsistencies have resulted in sentencing disparities and legal uncertainty. This study aims to analyze the organizational structure and modus operandi of organized online gambling networks and to examine the application of general criminal law in comparison with special criminal law based on the principle of lex specialis derogat legi generali and the objectives of criminal punishment. This research employed a normative juridical method using statutory and case approaches. The study relied on primary, secondary, and tertiary legal materials, which were analyzed qualitatively through library research focusing on Decision Number 1308/Pid.Sus/2021/PN.Jkt.Utr and Decision Number 491/Pid.Sus/2023/PN.Jkt.Utr of the North Jakarta District Court. The findings indicate that both decisions reveal online gambling as a form of organized crime characterized by a hierarchical organizational structure, systematic division of roles, and extensive use of information technology. Decision Number 1308/Pid.Sus/2021/PN.Jkt.Utr, which applied Article 303 of the Indonesian Criminal Code, was considered inadequate in addressing the cybercrime dimension of the offense because it overlooked the application of the ITE Law as a special criminal statute. In contrast, Decision Number 491/Pid.Sus/2023/PN.Jkt.Utr appropriately applied the provisions of the ITE Law, thereby providing greater legal certainty and reflecting a more progressive approach to law enforcement against organized online gambling. Accordingly, the application of the ITE Law as lex specialis should be prioritized in prosecuting online gambling offenses to ensure legal certainty, justice, and effective criminal sanctions.
