Abstract
Smoking while driving on public roads has the potential to endanger traffic safety and the health of other road users through exposure to cigarette smoke, ash, and burning embers. This study aims to analyze the fulfillment of the right to health for victims affected by smoking while driving, as well as the criminal law policies addressing such conduct in Indonesia and several other countries as a basis for legal reformulation. This research employs a normative juridical method using statutory and conceptual approaches. The findings indicate that the fulfillment of the right to health for affected victims has not been optimally realized because Law Number 22 of 2009 concerning Road Traffic and Transportation does not explicitly regulate smoking while driving. Although Article 6 letter c of Minister of Transportation Regulation Number 12 of 2019 prohibits smoking while operating a motorcycle, the scope of this provision is limited to motorcycle drivers providing services for public purposes and therefore does not comprehensively regulate all motor vehicle drivers. This regulatory limitation creates legal uncertainty and weakens legal protection for affected road users. The comparative study demonstrates that the United Kingdom, Australia, and Canada have adopted more explicit and specific prohibitions with a strong health-protection orientation, particularly concerning children as a vulnerable group. Singapore imposes smoking restrictions on public service vehicles while applying certain limitations to private vehicles, whereas Thailand adopts a smoke-free area approach without specifically prohibiting smoking while driving private vehicles. These comparative findings demonstrate the need to reformulate Indonesia’s criminal law policy by expressly prohibiting smoking while driving, establishing clear and proportionate legal elements and sanctions, and strengthening the protection of road users’ right to health.
