Abstract
This study aims to analyze the dispute resolution process through mediation leading to the issuance of a settlement judgment in Case Number 827/Pdt.G/2023/PN.Jkt.Pst and to examine the legal certainty of mediation outcomes in resolving copyright disputes related to the economic rights of song royalties. This research employs a normative legal research method using statutory, case, conceptual, and comparative approaches, with Singapore serving as the comparative jurisdiction. The legal materials consist of primary, secondary, and tertiary legal sources, which are analyzed qualitatively using Gustav Radbruch's Theory of Legal Certainty and the Principle of Proportionality. The results of the study indicate that Case Number 827/Pdt.G/2023/PN.Jkt.Pst was successfully resolved through mediation in accordance with the Supreme Court Regulation Number 1 of 2016, resulting in a settlement agreement that was formalized in a Settlement Deed (Akta Perdamaian/van dading), thereby possessing binding force and executorial power equivalent to a final and binding court judgment. The study further demonstrates that the legal certainty of mediation outcomes has not yet been fully established independently, as their binding force and executorial power remain dependent upon judicial confirmation through a Settlement Deed. In comparison, Singapore has established a more independent mechanism for the enforcement of mediated settlement agreements, whereas the Indonesian legal system continues to place mediation outcomes in close connection with the litigation process. Therefore, strengthening the regulatory framework concerning the legal status, binding force, and executorial power of mediation outcomes is necessary to enhance legal certainty in resolving copyright disputes related to the economic rights of song royalties.
