Abstract
The rapid advancement of artificial intelligence (AI) technology, particularly generative models, has raised legal challenges regarding the use of human artworks as training datasets without the copyright holder's permission. This normative legal research aims to analyze copyright protection concerning this practice in Indonesia, focusing on the application of the fair use doctrine under the Copyright Law and comparing regulatory approaches in other countries. The findings indicate that the fair use concept under Law No. 28 of 2014 is limited and enumerative, thus cannot serve as a legal basis for AI training that utilizes copyrighted works on a massive scale without permission. Current Indonesian regulations do not specifically address this issue, creating legal uncertainty and potential rights infringement, as illustrated in the case of Gibran Rakabuming Raka's AI video. A comparative study with the United States, the European Union, and Japan reveals various approaches, ranging from litigation and dataset transparency regulations to more lenient policies. Therefore, this research recommends the need to develop comprehensive regulations that balance creator rights protection with technological innovation needs, including refining fair use provisions, implementing dataset transparency principles, and enhancing the legal capacity of artists.
