Abstract
This study aims to analyze the political dynamicsin the drafting of PKPU No. 14 of 2024 with the removal ofsanctions. This study uses Michel Foucault's theory of power relations and William Dunn's theory ofpublic policy processes. The research method used is qualitativedescriptive with a case study approach. Data was obtained through interviewsusing purposive sampling techniques andliterature studies. The results of this study indicate that the change indisqualification sanctions in PKPU No. 14 of 2024 was motivated by the absence ofprovisions for disqualification sanctions in Law No. 10 of 2016 for candidate pairswho were late or failed to report their LPPDK. Therefore, the sanction was replacedwith an administrative sanction in the form of a written warning to comply withthe provisions of the law. This change drew criticism from NGOs such as ICW and Perludem, which considered the removal a setback in the enforcement of campaign finance regulations. The change in sanctions has an impact on campaign finance reporting and the implementation ofregional elections. The imposition of administrative sanctions and tolerance for LPPDK reporting deadlinescould open up opportunities for candidate pairs to be non-compliant in reporting campaign funds. Although the KPU, as an independent institution, has the authority todraft the substance of PKPU, the drafting process through consultation meetings involving theKPU, stakeholders, the DPR, and the governmentcould open up opportunities for conflicts of interest that could affect the KPU's independencein regulatory decision-making
