Abstract

The need for housing in Indonesia continues to increase every year, so that interest in flats in big cities continues to increase with payments using the Pre-Project Selling payment system. However, with this payment there are developers who are not trustworthy so that they cannot carry out handovers to consumers. The case of failed apartment handovers in Decision Number: 92/PDT.G/2017/PN.Jkt.Sel with the Pre-Project Selling payment system is one of the cases of failed apartment unit handovers that have occurred. The results of the analysis show that the Court decided that the developer of the Antasari 45 Apartment had committed an Unlawful Act by not handing over the apartment unit to consumers. This study aims to determine how the Pre-Project Selling system regulations regulated in Indonesia relate to the concept of the Clear and Cash Principle and whether the regulations in Indonesia regarding the Pre-Project Selling system are strong enough for consumers.
