Abstract
The inability of the Copyright Law to face the development of the times with the presence of digital service technology has given rise to the application of the safe harbor principle which provides exemption from liability to digital platforms when there is use of copyrighted works in content creation by digital platform users. With the Constitutional Court Decision Number: 84/PUU-XXI/202 which expands the definition of "trading place" and "goods" in the provisions of Article 10 of the Copyright Law, it then brings a new situation regarding legal responsibility to UGC-based digital platforms for the use of copyrighted works in their content. This legal research aims to consider the judge's legal responsibility for the UGC-based digital service platform in the use of copyrighted song works in the Constitutional Court Decision Number. 84/PUU-XXI/2023 and to analyze the legal responsibility of the UGC-based digital platform manager for the use of copyrighted song works without permission Post Constitutional Court Decision Number. 84/PUU-XXI/2023. The legal research method used in writing this thesis is to use the normative juridical research method, with a statute approach, case approach, and conceptual approach. The nature of this legal research is prescriptive analytical, with an analysis method through extensive interpretation. The results of the study show that the consideration of the panel of judges regarding the terms "trading place" and "goods" in the Constitutional Court Decision Number: 84/PUU-XXI/2023 must be interpreted broadly as a digital technology-based trading place in order to be able to reach various forms of copyright infringement in the field of digital technology. So that by expanding the definition, it can provide legal accountability to UGC-based platform managers as long as there is no good faith in implementing a copyright infringement prevention system on the Digital Platform they own and there is an intention to commercially exploit copyrighted works uploaded and stored on the digital platform by its users.
