Abstract

The background for writing this thesis was due to a dispute over the exchange of village treasury land objects with community land between the government and residents as stated in case decision No.26/Pdt.G/2017/PN.Dmk. The formulation of the problem in this thesis are what factors influence the parties to end the dispute over the exchange of village treasury land between the Singorejo government and the residents by making a peace agreement through mediation in the case of case decision No.26/Pdt.G/2017/PN.Dmk and how the settlement of cases of exchanging land objects of village treasury land and residents between the village government and residents provides legal justice and legal certainty. settlement of disputes resulting from the research, it can be concluded that the peace agreement from the results of Mediation both carried out in Court and outside the Court is then confirmed as a peace deed (acte van dading) that has permanent legal force, cannot be appealed or cassated, and has perfect evidentiary power, and has executorial legal force. The peace agreement will provide legal certainty for the parties to the dispute if it is confirmed as a peace deed (acte van dading) through a court decision.
