Abstract

In this research, the author discusses the legal aspects of PT authority. Perhutani Regarding Confiscation of HGU Plantation Land which has the Impact of Unlawful Acts, as well as to understand and analyze the settlement process and its results, in cases of confiscation carried out on plantation land which legally has a certificate of cultivation rights (HGU) as regulated in the UUPA in Government Regulations Number 40 of 1996 concerning Business Use Rights and also completeness of other permits owned by PT Bersama Sejahtera Sakti. The method used in this research is a normative juridical method which comes from legal material sources by examining statutory regulations related to this research. The conclusion obtained in this discussion is that with the decision of the supreme court which has canceled the decision of the court of first instance and the court of appeal there has been a legal unlawful act which has resulted in material and immaterial losses to PT. Bersama Sejahtera Sakti due to confiscation by force (dwang middelen) which was not based on approval or permission from the Chairman of the District Court and a criminal act committed by PT. Together with Prosperous Sakti.
