Abstract
Marriage is an inner birth bond between husband and wife, according to Law Number 16 of 2019 the minimum age of marriage is 19 years for both partners. Early marriage cases are still widely found in Indonesia, especially in the jurisdiction of the Tangerang Religious Court. This study focuses on the legal consequences of early marriage and uncertainty of the regulation because there are still many early marriages. This research is a qualitative legal research using juridical-normative methods. The statutory and case approach is used to examine legal issues by referring to library materials, especially Law Number 1 of 1974 concerning Marriage and Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. The data sources involved primary, secondary, and tertiary legal materials, as well as an interview with a judge of the Tangerang Religious Court. Data collection is carried out through literature studies and interviews, with analysis using analytical descriptive methods to present a systematic picture and answers to the subject matter. From this research it can be concluded that the implementation of Law Number 16 of 2019 has not been optimal, seen from the large number of requests for marriage dispensation and many problems will be found from underage marriages.
