Abstract

Narcotics Crime is a violation of the law and is also one of the crimes committed in an organized manner. The development of narcotics crime in Indonesia has been increasing rapidly as evidenced by the many types of narcotics on the black market showing that access to and networks of narcotics have expanded. The easier the illicit goods are obtained, the more abusers of narcotics will be. The abuse of narcotics is certainly considered troubling for the community, especially the people around them. The consequences of narcotics abuse can be felt by himself and others. In terms of settling the handling of narcotics crime cases, it will usually tend to give harsh (punitive) punishments so that currently the inmates of Correctional Institutions (LAPAS) have exceeded their proper capacity. Therefore, in 2021, the Attorney General issued Guidelines for the Attorney General Number 18 of 2021 concerning Completion of Handling Cases of Crime of Narcotics Abuse through Rehabilitation Using a Restorative Justice Approach as Implementing the Prosecutor's Dominus Litis Principle. The guideline presents a concept of rehabilitation as restorative justice for narcotics abusers with the provisions contained therein. This study uses normative juridical research methods using descriptive analysis techniques. The results of the research will discuss the role and constraints related to the implementation of restorative justice for narcotics abusers from the point of view of a Public Prosecutor.
