Abstract
Various cosmetic products can be easily found in online marketplaces. BPOM as a government institution that carries out supervision of the distribution of drugs and food including cosmetics in Indonesia, needs to carry out online supervision to prevent the distribution of products which has unguaranteed quality. The Ordinary AHA 30% + BHA 2% Peeling Solution product with 30% AHA content which is prohibited by BPOM, can be easily found in the marketplace. This research is a normative juridical using statutory approach which is carried out by examining laws and other regulations related to the legal issues. The sources of data in this study were obtained through laws and regulations and literature which were processed by qualitative analysis with reference to the theory of legal responsibility by Hans Kelsen. After analyzing the problems with the relevant laws and regulations, the results are that BPOM’s supervision of the online distribution of cosmetic products which content is prohibited is carried out in the form of supervision of circulating products and taking action against businessperson and electronic system operators who distribute these products. BPOM is collectively responsible for the distribution of cosmetic products with 30% AHA content. BPOM’s responsibility to the online distribution of cosmetics with 30% AHA content has not been fulfilled considering the fact that these products are still distributed freely in various marketplaces.
