Abstract
This research is about the use of copyright by government institutions in showing films in the Learning From Home Program without the permission of the copyright holder. The violation began when the Ministry of Education and Culture asked In-Docs (Society Foundation Mandiri Film Indonesia) to recommend Indonesian documentaries to be shown in the Ministry of Education and Culture's BDR program on TVRI. In-Docs asked for a draft contract but the draft contract was never sent. On June 25, 2020, the film How Far I’ll Go aired on mainstream media without contract, without permission, and without notice to In-Docs. The urgency of this research namely How to use copyright by the Ministry of Education and Culture of the Republic of Indonesia in showing films “How Far I’ll Go” on the BDR program without the permission of the copyright holder and How should the use of Copyright by Government Institutions in screening films. This study uses a normative method with research instruments in the form of observations and interviews. The results of this study are that the use carried out by the Ministry of Education and Culture of the Republic of Indonesia in the film How Far I’ll Go is illegal and the Ministry of Education and Culture should enter into a license agreement with the copyright holder as stipulated in the Copyright regulations. The suggestion in this research is use of the film How Far I’ll Go should be done by entering into a license agreement with copyright holders and government agencies in this case should act legally.
