Abstract
This research was conducted to find out and examine why the provisions regarding the use of cannabis for the benefit of health services prioritize a criminal approach, as well as to analyze how prospective cannabis is for the benefit of health services. The research method used is juridical normative qualitative in nature with the type of data analysis, namely descriptive analytical, with a statutory approach, namely Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics, Law of the Republic of Indonesia Number 36 of 2009 concerning Health, and Law - The Law of the Republic of Indonesia Number 5 of 1997 concerning Psychotropics, as well as the approach to Court Decisions in Criminal Cases Number: 623/Pid.Sus/PN.Bks/2020. The results of the research show that law enforcers now have more of their view of juridical dogmatic, and ignore the socio-cultural and socio-political aspects as well as the socio-philosophical basic values that live in Indonesian society. Thus, implementing the provisions of cannabis for the benefit of health services prioritizes aspects of punishment. The prospect of Indonesian cannabis for the benefit of health services has received legitimacy from the United Nations Commission on Narcotic Drugs which voted on December 3, 2020 and finally removed cannabis from the list of the most dangerous medicinal plants that is tightly controlled since the Single Convention on Narcotic Drugs United Nations in 1961 and approved the recommendations of the World Health Organization which relax cannabis for medical purposes. This voting decision can encourage every country to discriminate against cannabis for the benefit of health services. "Therefore, it is necessary to regulate the regulation of the use of cannabis for the benefit of health services, by amending Law Number 35 of 2009 concerning Narcotics which is outdated and revising implementing regulations, namely Regulation of the Minister of Health of the Republic of Indonesia Number 5 of 2020 concerning Changes in the Classification of Narcotics can also conduct a Material Test of the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics to the Constitutional Court of the Republic of Indonesia, ratify the latest UN Convention regarding changes in the classification of narcotics that have been decided by the United Nations Narcotics Commission on December 3, 2020, as well as issue a Presidential Regulation as an implementing regulation, so that our country's criminal policies prioritize restorative justice, so that the potential of Indonesian cannabis can be utilized for the maximum benefit of the health and medical industry without having to import from abroad.
