Abstract

Crime in cyberspace or cyber crime has experienced a significant increase. Unfortunately in international law, there are still many elements or types of crime in cyberspace that are still experiencing legal ambiguity. One type of cyber crime is cyber espionage. Cyber espionage is the act of secretly copying important data involving a computer system. This spionase siber act can have a negative impact in the form of disruption of the economic system, to the disruption of the sovereignty of a country. Therefore, the purpose of this study is to determine the legality of cyber espionage based on international law and the state's responsibility towards it. This research is a normative juridical research and uses literature study technique. The data processing is done qualitatively by means of deductive thinking. The results of this study indicate that countries that commit spionase siber have violated their obligations to respect the sovereignty of other countries. In addition, although there is no prohibition related to cyber espionage in written law, cyber espionage still violates several basic principles in international law, including the principle of equality and the principle of non-intervention. However, because of the heavy proof system, a country will find it difficult to hold other countries accountable for the cyber espionage it commits. It is not easy to find out the real perpetrators of cyber crimes because of various technical problems. Based on this, the authors suggest to the government and society to further improve the cyber security system.
