Abstract

The rapid development of Electronic Commerce (E-Commerce or PMSE) has significantly increased the role of e-commerce platforms in facilitating commercial transactions, including Shopee as an Electronic Commerce System Provider (Penyelenggara Perdagangan Melalui Sistem Elektronik or PPMSE) that completes transactions through an escrow mechanism. Pursuant to Article 65 of Government Regulation Number 80 of 2019 (Peraturan Pemerintah Nomor 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik) concerning Electronic Commerce, a PPMSE that completes a transaction is responsible for the delivery of goods. However, in practice, Shopee implements a limitation of liability clause that restricts the scope and extent of its liability, while its shipping insurance mechanism remains optional, resulting in unequal protection against the risks of loss or damage to goods among users. This study employs a normative juridical research method using statutory, conceptual, and case approaches. The findings indicate that Shopee's liability arrangement through limitation of liability clauses and the uninsured compensation mechanism has not fully provided proportionate legal protection for users. Therefore, the shipping insurance mechanism should be optimized as a form of risk mitigation by providing more effective protection for transactions involving a high risk of loss, thereby enabling PPMSEs to fulfill their responsibilities in accordance with Article 65 of Government Regulation Number 80 of 2019.
