Abstract
This research examines the synchronization of regulations on royalties and music licensing in Indonesia from the perspective of copyright protection law. The focus is on the implications of disharmony between national regulations and international agreements on the enforceability of licensing agreements between creators and copyright holders. The purpose of this study is to analyze how regulatory disharmony in royalties and music licensing can be addressed to create fair rules for both creators and users of creative works, as well as to assess the extent to which current policies and law enforcement ensure that copyright holders receive their economic rights fairly and are protected from unauthorized use or exploitation by third parties. This research employs a normative legal method using a statute approach and a conceptual approach. The statute approach is applied to analyze existing provisions in the Copyright Law and related regulations, while the conceptual approach is used to discuss legal concepts underlying music licensing regulations and copyright protection in both global and national contexts. The findings of this study indicate that the implications of disharmonized music licensing regulations on the enforceability of licensing agreements between creators and copyright holders reflect a weak integration of legal norms within the national legislative system, particularly concerning the coherence between the Copyright Law, its implementing regulations, and the technical regulations of collective management organizations. This lack of harmonization results in legal uncertainty, which undermines the certainty and effectiveness of licensing agreements and potentially leads to breaches of contract or copyright infringements. Harmonizing music licensing regulations between creators and commercial users is a crucial element in ensuring copyright protection and establishing fair governance in the music industry. Although Law Number 28 of 2014 on Copyright provides a strong normative basis, its implementation still faces challenges, especially regarding the structure of licensing clauses, transparency in royalty distribution, and the effectiveness of Collective Management Organizations (CMOs). Therefore, this study recommends regulatory harmonization through institutional strengthening of CMOs and the establishment of national standardized licensing clauses that are more transparent, in order to create legal certainty and better protect the rights of creators.
