Abstract

Over The Top is streaming media such as movies, series, and documentaries aired by production houses. More broadly, OTT is implemented in the form of applications and application services, forms of video and audio streaming, messaging and social networking. The decrease in the number of consumers watching pirated movies on illegal streaming websites is a positive thing that will have a good impact on the Indonesian film industry. However, the disappearance of a problem can certainly cause new problems. The existence of OTT services makes some people take advantage of existing services for their own benefit by pirating movies and series that are aired on certain legal streaming services and then uploaded on the Tiktok application. This study aims to determine the legal protection of cinematographic works that are distributed without permission and how legal efforts can be made by copyright holders in resolving these disputes. This research uses a qualitative method with a statutory approach to Law Number 28 of 2014 concerning Copyright. The results of this study indicate that cinematographic works are protected by law which regulates the protection of a work from acts of infringement that can harm and violate the exclusive rights of the creator. That is why in order to restore the exclusive rights of the violated creator, the creator can take preventive or repressive efforts through litigation and non-litigation.
