Abstract
The percentage of active paid music streaming users globally has increased drastically yearly. Data from DataIndonesia and Databoks evidence this improved performance, where the number of Spotify's monthly active users worldwide increased by 18.6%. However, this increase in the number of active music users in Indonesia is not accompanied by the development of regulations on Music Copyright in Indonesia. This study aims to determine the laws and regulations related to Music Copyright as an object of the Fiduciary Guarantee currently in effect in Indonesia and examine the challenges and obstacles in implementing legal reformulation of further regulation regarding Music Copyright. This research is normative legal research that uses interview data sources as supporting data. Data analysis uses the Statute approach and Conceptual approach. The research results show that the regulation of Music Copyright as an object of Fiduciary Guarantee in Indonesia has been regulated in the Copyright Law, the Creative Economy Law, and the Implementing Regulations of the Creative Economy Law. Based on the interviews, three challenges and obstacles were obtained in implementing music copyright guarantees as objects of fiduciary guarantees. Thus, by actualizing legal reformulation efforts on laws and regulations related to the problems above, it can be a progressive solution and create a dynamic legal system following societal developments.
