Abstract

Violation of the law on song copyright is something that often happens today. Using someone else's work without permission and used for commercial purposes such as broadcast or traded including violations, namely piracy in the form of duplication of copyrighted works. This study aims to determine how the legal protection of copyright holders who have transferred their economic rights, which are then used by other parties to be distributed and then traded without permission, thus causing harm to the copyright holder. The research was conducted based on the study of decision No. 07/Pdt.Sus-HAKI/Cipta/2019/PN Niaga Sby. The type of research used in this research is normative juridical. In this study the author uses a statutory approach (statute approach), namely specifically Law No. 28 of 2014 concerning copyright and with a case approach by analyzing the case in the decision. The results of this study indicate that despite the transfer of economic rights of a creation but as a copyright holder whose name has been recorded in the certificate of recording of creation, still get legal protection for copyright infringement that resulted in harm to him, based on the Copyright Act.
