Abstract

Abstract Sexual crime against children (pedophilia) in Indonesia has increased from year to year which is alarming, so the government made Perppu Number 1 of 2016 which has been stipulated to become Law Number 17 of 2016 by providing additional penalties in the form of chemical castration punishment against perpetrators. The problem is whether castration punishment as an additional crime is in accordance with the criminal system in Indonesia and how the implementation of castration punishment as an additional crime in a sexual crime. This research uses normative legal research with the legislation approach, concept approach, comparative approach and case approach. The conclusion of this research is that castration punishment as an additional criminal is suitable in the Indonesian criminal system which adopts a combined theory by creating a deterrent effect and providing benefits through the rehabilitation process. Castration punishment as an additional crime in a sexual crime has no technical implementation rules. A legal comparison is needed with countries that have implemented castration penalties as a reference in perfecting existing legal rules, so that their implementation is appropriate for use in Indonesia.
