Abstract

Corruption is rooted in the pace of life of the Indonesian state, it clearly threatens the country's economy, corruption can also damage the environment, democratic institutions, human rights. There are provisions that are not yet regulated in the current law specifically in the Corruption Eradication Act, which is about trading in influence. The subject of the law of trading in influence of these actors can be carried out by public officials until others, then, the actors of trading in influence get an improper advantage. The absence of regulation regarding the formulation of trade offense influences in positive law in Indonesia has caused officials and law enforcers to often use bribery delic, this results in confusion that occurs continuously only to be able to ensnare the perpetrators and not just get away without criminal sanctions, therefore there is a need for written rules regarding the offense of trading in influence as an offense that enters into a criminal act of corruption, hence the need for criminalization regarding the trading of influence. There was a case of an influence trade involving a former DPD RI Chairman Irman Gusman regarding imported sugar bribes, Irman Gusman used his influence or authority to do things that were not supposed to and aimed at benefiting himself and others.
