Abstract
The purpose of this study was to analyze the Implementation of the Authority of the Liquidation Team in the Process of Bank Liquidation (Liquidation of PT. Bank Global Internasional, Tbk), which has not received legal certainty and legal protection. Through this research, it is explained in relation to the Implementation of the Authority of the Liquidation Team in the Bank Liquidation Process (Liquidation of PT. Bank Global Internasional, Tbk) and the efforts of the Liquidation Team in dealing with obstacles in the Implementation of the Authority of the Liquidation Team in the Process of Bank Liquidation (Liquidation of PT. Bank Global Internasional, Tbk) . This study uses empirical juridical research methods, namely research that uses empirical facts taken from human behavior, both verbal behavior obtained through interviews and real behavior carried out through direct observation. The constraints faced by the Liquidation Team in the Implementation of the Authority of the Liquidation Team in the Process of Bank Liquidation (Liquidation of PT. Bank Global Internasional, Tbk) are: address without notice; b) The debtor refuses his assets pledged to the Bank for auction or makes it difficult for the collateral to be executed by the Team; c) In the case of shareholders avoiding or fleeing in settling their obligations to the Bank; d) The debtor refuses his assets pledged to the Bank for auction or makes it difficult for the collateral to be executed by the Liquidation Team. Efforts made by the Liquidation Team are: a) for uncooperative debtors, the Liquidation Team submits legal actions through the court; b) for debtors who move the address of the Liquidation Team to check into the field and look for the address of the relevant agency; c) for debtors who refuse their assets pledged to the Bank to be auctioned or make it difficult for collateral to be executed by the Liquidation Team is to make a police report with the debtor's argument obstructing or complicating the execution of debt guarantees and filing a lawsuit through the court. d) In the case of shareholders avoiding or fleeing in settling their obligations to the Bank, the effort made by the liquidation team is to make a police report with the argument that the shareholders avoid / refuse to settle the Bank's obligations including to the depositors and submit a legal suit through the court.
