Abstract
The development of artificial intelligence technology has changed the paradigm of human interaction with digital platforms, such as the birth of an AI-based customer service platform, namely HALO AI with an Automated Decision Making (ADM) mechanism to automatically answer customer messages. This study aims to analyze and explain the forms of implementation of the suitability of the ADM mechanism on the HALO AI platform to the principles of personal data protection as regulated in the PDP Law, also formulating forms of legal accountability and legal protection efforts that can be carried out by data subjects in the event of a privacy violation. This study uses a normative juridical method by analyzing library materials or secondary data that include legal principles, synchronization of laws and regulations, and legal systematics related to personal data protection and artificial intelligence. In an effort to protect consumer data, HALO AI needs to apply the principle of privacy by design, namely the affirmation of privacy from the beginning of the system design. In addition, the platform must also provide consumer services to have the right to receive an explanation from humans if there is confusion in the answers from the AI system (right of explanation). If the HALO AI platform, as a Data Processor, fails to meet security standards, or if the Data Controller (company/MSME) is negligent in overseeing this automated processing, the PDP Law threatens strict sanctions, ranging from administrative fines to criminal sanctions.
