Abstract
This study aims to analyze the regulation of land control by foreign nationals within the land law systems of Indonesia and Malaysia and to examine the juridical consequences of these differences on the effectiveness of property investment policies in Indonesia. The study is grounded in the tension between the nationality principle under the Basic Agrarian Law (UUPA), which restricts land ownership for foreign nationals, and the need to enhance foreign investment in the property sector. This research employs a normative legal method with statutory and comparative approaches. The findings indicate that Indonesia adopts a restrictive approach by limiting foreign nationals to the right of use, whereas Malaysia, through the National Land Code 1965, applies a more open approach while maintaining administrative control. These differences generate juridical consequences, where Indonesia’s strict limitations protect agrarian sovereignty but also encourage legal circumvention practices such as nominee agreements that are potentially null and void, as affirmed in the Denpasar High Court Decision Number 144/PDT/2021/PT DPS, which declares such agreements invalid and legally unenforceable. This condition leads to decreased investment attractiveness and increased legal uncertainty, thus requiring policy harmonization through strengthening the right of use framework, enhancing supervision of beneficial ownership, and selectively adopting best practices from Malaysia to achieve a balance between agrarian sovereignty protection and property investment competitiveness.
