Abstract
Israel's naval blockade of the Gaza Strip, including the interception of the Madleen on the high seas in 2025, raises legal issues regarding the legality of these actions under international maritime law and international humanitarian law. The Madleen is a British-flagged humanitarian aid ship carrying food, medicine, and medical supplies to the Gaza Strip. This study aims to analyze the legality of Israel's maritime blockade of the Madleen and examine the legal remedies that flag states can take in response to these actions. This study is a normative juridical study using a statute approach, a conceptual approach, and a case approach. The legal materials used include UNCLOS 1982, the Geneva Conventions 1949, the San Remo Manual on International Law Applicable to Armed Conflicts at Sea 1994, and various relevant international legal literature. The research results show that the Israeli blockade raises legal issues related to the principle of freedom of navigation, the protection of civilian vessels and humanitarian aid, and the state's obligation to ensure access to humanitarian aid for civilians. As a flag state, the UK has various international legal instruments to protect vessels flying its flag through diplomatic channels and international dispute resolution mechanisms. In disputes involving various international legal regimes, the International Court of Justice (ICJ) can be an alternative resolution if its jurisdictional basis is met, as it allows for a more comprehensive application of various sources of international law.
