Abstract

The objective of this research is to analyse the legal framework governing the cancellation of unused trademarks in Indonesia, using a case study of the inconsistencies between commercial court rulings and Supreme Court decisions, with a focus on the inconsistencies in the decisions of the Commercial Court and the Supreme Court in interpreting the provisions of Article 74 of Law No. 20 of 2016 on Trademarks and Geographical Indications. This study employs a normative legal methodology, utilising a statutory approach, a case-based approach, a conceptual approach, and a comparative law approach. An analysis was conducted of the decisions of the Commercial Court and the Supreme Court, and these were compared with the legal system of the United States and China. The research findings indicate that inconsistencies in court rulings are caused by the absence of qualitative standards regarding genuine use and unstructured evidentiary mechanisms. Furthermore, the trademark cancellation system Indonesia remains reactive through litigation, making it inefficient and ineffective in preventing trademark hoarding. This contrasts with the United States, and China. Based on these findings, this study recommends legal reform through the establishment of qualitative standards for trademark use
