Abstract

Phishing crimes in the digital banking system in Indonesia continue to increase along with the development of information technology and low digital literacy of the public. This study aims to analyze the factors causing the rise of banking phishing crimes and efforts to improve the legal and banking systems to minimize these crimes, with a case study at Bank BPD Bali. The research method used is normative juridical with a statutory regulatory approach and case studies. The results of the study indicate that phishing is influenced by human, psychological, and technological factors, as well as weak legal regulations that specifically regulate phishing crimes. Legally, phishing acts can be subject to the provisions of Law Number 11 of 2008 concerning Information and Electronic Transactions as amended by Law Number 19 of 2016, specifically Article 30 and Article 28 paragraph (1), and Law Number 27 of 2022 concerning Personal Data Protection. Furthermore, banks have a legal obligation to protect customer data and funds under Law No. 10 of 1998 concerning Banking and Law No. 8 of 1999 concerning Consumer Protection. Regulatory strengthening, improvements to banking security systems, and ongoing public education are needed to suppress phishing crimes in the banking sector.
