Abstract
Terrorism as an extraordinary crime demands extraordinary repressive measures, including the death penalty. However, the enactment of the National Criminal Code (Law No. 1 of 2023) has shifted the status of the death penalty to an alternative punishment with a 10-year probation period, potentially creating a gap between national security needs and human rights protection. This study aims to analyze the impact of the death penalty on terrorist offenders in Indonesia and identify the juridical and operational obstacles in its implementation amidst legal transition. Using a normative juridical method with statute and case approaches, this study finds that the death penalty has an ambivalent impact: on one hand, it effectively disrupts terrorist command chains, but on the other hand, it risks triggering martyrdom glorification and transforming modus operandi into sporadic lone-wolf attacks. The main obstacles lie in the vulnerability of the 10-year probation mechanism to manipulation through taqiyah (dissimulation) tactics due to the absence of objective assessment indicators in regulations, as well as structural weaknesses in the correctional system and unlimited extraordinary legal remedy procedures. This study concludes that this legal transition potentially weakens the repressive function of the death penalty. Therefore, it is recommended that policymakers and law enforcement officials immediately formulate Standard Operating Procedures (SOPs) with rigid and layered psychological assessment indicators to accurately evaluate the good conduct of terrorist convicts.
