Abstract

This study aims to analyze legal protection for victims and vulnerable groups under the 2025 Indonesian Criminal Procedure Code (KUHAP) and compare it with the Dutch legal system. The research employs a normative juridical method with statutory and comparative approaches. The findings indicate that the 2025 KUHAP has shifted the paradigm from an offender-oriented system to a victim-oriented approach, recognizing broader victim rights, including protection, access to information, restitution, and participation in criminal proceedings. However, its implementation still faces challenges such as weak operational mechanisms, limited institutional coordination, and a legal culture that remains offender-focused. In contrast, the Netherlands has developed a more structured and practical victim protection system through individual needs assessments, strong institutional support, and concrete recovery mechanisms. Therefore, strengthening implementation, institutional integration, and a needs-based approach are essential for improving victim protection in Indonesia.
