Abstract
Corruption is an extraordinary crime that causes state financial losses, obstructs national development, and harms society. However, the handling of corruption cases in Indonesia remains dominated by a retributive approach that focuses on imprisonment, while the recovery of state losses has not been optimal. This study aims to analyze the current handling of corruption crimes and the recovery of state losses in Indonesia, as well as to examine the application of restorative justice principles as an alternative sentencing approach in the future. This study uses normative legal research with statutory, conceptual, and comparative approaches. Primary, secondary, and tertiary legal materials are analyzed qualitatively to formulate legal concepts that align with the objectives of the study. The findings show that the asset recovery mechanism in corruption cases has not worked optimally because law enforcement still focuses on punishing offenders. The application of restorative justice principles may serve as an alternative by placing the recovery of state losses as the main objective without eliminating the criminal liability of the offender. The concept proposed in this study is the repayment of state losses at four times the value of the losses caused, in order to strengthen deterrence and improve the effectiveness of state financial recovery. This study concludes that the reformulation of Article 4 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law Number 20 of 2001, is necessary to strengthen asset recovery. Therefore, lawmakers need to regulate a more effective mechanism for recovering state losses through a restorative justice approach.
