Abstract
Sexual violence constitutes a crime that inflicts physical, psychological, and social impacts on victims. Challenges often arise during the evidentiary process in such cases due to a scarcity of witnesses or direct evidence. However, victims frequently undergo medical examinations or receive healthcare services before the case is reported to law enforcement; consequently, medical records serve as a source of information that can objectively depict the victim's medical condition. This study aims to analyze the status of medical records as a form of evidence and their evidentiary weight in cases of sexual violence. It employs a normative legal research method utilizing statutory, conceptual, and comparative approaches, drawing upon primary, secondary, and tertiary legal materials. The findings indicate that medical records hold a legitimate status as documentary evidence in sexual violence cases, as stipulated in Article 24 paragraph (3) of Law Number 12 of 2022 concerning Sexual Violence Crimes. Medical records possess both formal and material evidentiary weight, provided they are created by authorized healthcare professionals in accordance with professional standards and contain relevant medical facts. Nevertheless, in law enforcement practice, the use of medical records as evidence has not been optimally implemented due to differing understandings, assessments, and utilization by law enforcement officials and healthcare professionals; consequently, their evidentiary weight often depends on their consistency with the Visum et Repertum (forensic medical report) and the judge's assessment during the trial.
