Abstract
This research aims to analyze the authority of Non-Ministerial Government Institutions (NMGIs) in initiating Bills within the executive branch, examine the legal, administrative, and institutional implications of the existing regulatory framework, and formulate an ideal concept for the authority of NMGIs in initiating Bills. This study employs normative legal research using statutory, conceptual, and comparative approaches. Primary, secondary, and tertiary legal materials were collected through library research and analyzed qualitatively using a prescriptive method. The findings indicate that Article 47 of Law Number 12 of 2011 on Lawmaking, as lastly amended by Law Number 13 of 2022, authorizes NMGIs to prepare Bills, draft Academic Papers, and establish Inter-Ministerial Committees. However, Article 50 paragraph (2) limits the Government's representation in parliamentary deliberations exclusively to ministers. Consequently, although NMGIs may initiate and prepare Bills substantively, the legislative process remains dependent on the coordinating ministry, resulting in coordination challenges and sectoral ego. This research finds that the fragmentation of authority arises from the separation between the authority to prepare Bills and the authority to formally represent the Government before Parliament. To address this issue, the study proposes a dual-initiator model distinguishing between the substantive initiator, namely the Non-Ministerial Government Institution responsible for the substance of the Bill, and the formal initiator, namely the minister appointed by the President through a Presidential Letter to represent the Government during parliamentary deliberations. This model is expected to ensure continuity in the legislative process, strengthen institutional coordination, and remain consistent with the principles of the presidential system.
