Abstract

The rapid transformation of financial services into the digital realm poses serious threats in the form of cybercrimes, which frequently lead to massive losses of customer funds. This phenomenon triggers disputes and a liability gap between banks and customers. This research aims to analyze the current legal liability framework of digital banking in Indonesia and formulate a more equitable ideal model. Utilizing a normative legal research method supplemented by in-depth interviews, the approaches applied include statutory, case, and conceptual approaches. The results indicate that although recent regulations, such as the Consumer Protection Law and POJK No. 22 of 2023, have obliged banks to actively manage cyber risks, in practice, banks still frequently hide behind the pretext of customer negligence. The conclusion of this study offers a solution by adopting the UK-style shared liability model, which applies the shifting burden of proof to the bank. Therefore, it is recommended that the Financial Services Authority (OJK) revise the aforementioned POJK and issue a lex specialis technical regulation regarding compensation procedures and the proportional distribution of loss burdens among banks.
