Abstract
The Widuran Fried Chicken business failed to provide transparent and clear information to its consumers, including Muslim consumers. This study addresses two issues: first, the violation of Article 26 of the Halal Product Guarantee Law committed by the Widuran Fried Chicken business and second, the legal liability of the business for this violation. This study uses an empirical juridical research method with a research approach that utilizes a legislative approach and a case approach. This study uses primary and secondary data. The empirical aspects of this study were obtained through interviews with consumers, BPJPH, the Trade Office, the Tourism Office, and the Indonesian Consumer Protection Foundation (YLKI). Based on the results of these interviews, it was found that consumers did not obtain adequate information regarding the nonhalal status of products, there was a view from related agencies that business actors should include nonhalal information openly from the start, and there was a discrepancy between the implementation of business actors' obligations and the provisions of Article 26 of the JPH Law. These empirical findings were then analyzed using legal protection theory, legal responsibility theory and Law Enforcement Theory. The results of this study show that first, the violation of Article 26 of the Halal Product Assurance Law committed by the business operator of Ayam Goreng Widuran is the failure to include a nonhalal label or logo on its packaging or business promotional posters, even though lard is used in the processing of its kremesan (crispy batter crumbs). In fact, pork/lard is categorized as a nonhalal ingredient under Article 18 Paragraph (1) of the Halal Product Assurance Law. Furthermore, this action also violates Article 4, Article 7, and Article 8 Paragraph (1) of the Consumer Protection Law. Second, such actions can lead to legal liability for the business operator. The conclusion of this study is that the business actor violated Article 26 of the Halal Product Guarantee Law and several articles in the Consumer Protection Law. The Widuran Fried Chicken business actor could be subject to three types of legal liability: civil, criminal, and administrative.
