Abstract
This study aims to examine the legal status of name-lending agreements as instruments of legal circumvention in land disputes adjudicated by the Denpasar District Court in Decision No. 872/Pdt.G/2020 and to analyze the judges’ legal reasoning in the Denpasar District Court’s Decision No. 872/Pdt.G/2020. Using a normative legal research method through an approach involving legislation and case studies, this study demonstrates that name-lending agreements between foreign nationals and Indonesian citizens constitute legal circumvention because they are often entered into with the intent to evade applicable Indonesian laws. In the Denpasar District Court Decision No. 872/Pdt.G/2020, it was ruled that the name-lending agreement between the foreign national and the Indonesian citizen is null and void, and the sale and purchase transaction between the Defendant and the Intervening Defendant is valid; therefore, the Intervening Defendant is the lawful owner of the disputed property. However, if we refer to Article 26(2) of the Basic Agrarian Law (BAL), which explicitly states that any transfer of land ownership rights whether directly or indirectly to a foreign national results in the transfer being null and void and the land reverting to the state, then the subject of the dispute should revert to the state.
