Abstract
Norway is one of the countries that still actively engages in whaling activities. It is the only country that has consistently maintained its commercial whaling activities to date, utilizing the objection mechanism in Article V of the ICRW to be exempt from the International Whaling Commission (IWC) moratorium on commercial whaling in 1982. This study aims to analyze the factors behind Norway's rejection of the IWC moratorium through two analytical frameworks: international regime theory and national interest theory. The research method used is descriptive qualitative with a case study approach. Data were collected through a literature review of official IWC documents, academic journals, and interviews with expert sources. This study uses Krasner's international regime theory, Chayes and Chayes's concepts of compliance and non-compliance, and the concept of national interest. The results show that Norway's non-compliance with the international regime is caused by a combination of regime issues and national interests. First, the structural weaknesses of the IWC regime are evident in the neglect of scientific committees, the ambiguity of norms, and the ambiguity of rules that simultaneously weaken the regime's effectiveness. Second, Norway's national interests that heavy on political factors, influence each other in maintaining whaling activities. As long as inconsistencies persist in the IWC regime, there will be no fundamental change in Norway's position on the issue of commercial whaling.
