Abstract
The absence of a clear definition and legal parameters regarding trade secrets, coupled with the legal vacuum concerning the liability of individuals who do not qualify as business actors, indicates that Article 23 of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition has not yet provided adequate legal protection and legal certainty for business actors owning trade secrets. Furthermore, following Constitutional Court Decision Number 85/PUU-XIV/2016, which replaced the phrase "other parties" with "other business actors", individuals involved in conspiracies to obtain trade secrets can no longer be held liable under Law Number 5 of 1999. This research aims to analyze the legal protection afforded to business actors whose trade secrets have been unlawfully obtained through conspiracy, as well as the legal reasoning of the Commission Panel of the Business Competition Supervisory Commission (KPPU) in Decision Number 08/KPPU-L/2024. This study employs a normative juridical research method using statutory and case approaches. The findings reveal that legal protection for trade secret owners remains inadequate due to the absence of clear legal parameters defining trade secrets and the legal vacuum concerning individual liability following Constitutional Court Decision Number 85/PUU-XIV/2016. Therefore, a reformulation of Article 23 of Law Number 5 of 1999 is necessary by establishing explicit legal parameters for trade secrets and regulating individual liability to ensure more effective legal protection and legal certainty.
