Abstract
This thesis was written by Anis Fauzan, Student ID Number 2410622028, under the title “Eksistensi Pembentukan Badan Peradilan Khusus dalam Penyelesaian Sengketa Pemilihan Kepala Daerah.” This research was conducted under the direction and guidance of the thesis advisory committee at the Master of Law Program, Universitas Pembangunan Nasional Veteran Jakarta. This study aims to explore the current mechanisms for resolving local head election disputes in Indonesia, which are considered to be fragmented and suboptimal. Additionally, this study aims to analyze and formulate an ideal institutional model for a special judicial body to handle local head election disputes in Indonesia in order to achieve substantive electoral justice. The background of this research highlights the complexity of local election disputes, ranging from the caseload at the Constitutional Court to normative conflicts following Constitutional Court Decision No. 85/PUU-XX/2022, which removed the temporary nature of the Constitutional Court’s authority, as well as the neglect of substantive justice due to legal formalism. The research method employed is normative legal research using a statutory approach and a conceptual approach, supported by comparative legal studies with other countries. The findings of the second study recommend the Administrative Court (PTUN) as a judicial institution that integrates the resolution of disputes regarding the process, ethics, and results of regional elections through a one-door system, with its decisions being final and binding and not subject to further legal action, similar to the models in Brazil and Mexico, by making amendments and adjustments to Law No. 5 of 1986 on the PTUN and Law No. 7 of 2017 on Elections. The novelty of this study lies in proposing the repositioning of the adjudicative functions of the Election Supervisory Agency (Bawaslu) and the Election Dispute Settlement Commission (DKPP) back within the judicial branch to restore Bawaslu’s true status as a state auxiliary organ that purely performs oversight and evidence-gathering functions, rather than acting as a dispute adjudicator.
