Abstract
The increasing number of environmental pollution and environmental destructioncases in Indonesia in recent years, including illegal mining activities, industrial waste pollution, forest and land fires, and ecosystem degradation resulting in ecological damage, economic losses, and loss of human lives, demonstrates that environmental law enforcement continues to face significant challenges. One of the contributing factors is the weak implementation, or even the deliberate failure, of government of icials to carry out their statutory duty to supervise environmental protection and management. Nevertheless, criminal liability against government of icials for suchintentional omission has rarely been enforced, despite being regulated under Article112 of Law Number 32 of 2009 on Environmental Protection and Management.Thisresearch aims to analyze the implementation and obstacles in enforcing Article 112of the Environmental Protection and Management Law (UUPPLH) against government of icials who intentionally fail to perform their environmental supervisory duties, aswell as to formulate a reconstruction of the legal norm and its implementation mechanism in order to provide greater legal certainty in environmental criminal lawenforcement in Indonesia. The study focuses on the ef ectiveness of Article 112inpractice and on developing an ideal legal formulation to strengthen the criminal liability of government of icials for intentionally allowing environmental pollutionand/or environmental destruction to occur. This research employs a normativejuridical legal research method using statutory, conceptual, case, and comparative approaches, supported by an analysis of several environmental pollution and environmental destruction cases that occurred in Indonesia over the last five years.The findings indicate that the implementation of Article 112 remains inef ective due to normative deficiencies, dif iculties in proving omission of enses (delict of omission), the absence of clear legal parameters defining intentional failure to supervise environmental compliance, and the lack of uniform guide lines for lawenforcement agencies. This study proposes a reconstruction of Article 112 by emphasizing that the subject of criminal liability should be the highest-ranking licensing authority inaccordance with its jurisdiction, strengthening the legal parameters governing omission of enses and criminal liability arising from supervisory failures, and recommending the development of implementation guidelines through the refinement of Supreme Court Regulation Number 1 of 2023. This reconstruction is expectedtoenhance the ef ectiveness, consistency, and legal certainty of environmental law enforcement while reinforcing the accountability of government of icials inenvironmental protection and management.
