Abstract
A bank guarantee is a banking service product that serves as assurance of the guaranteed party’s fulfillment of its obligations to the beneficiary. In practice, bank guarantees still face various challenges, such as the risk of document forgery, misuse, lengthy administrative processes, and insufficient legal protection for banks as guarantors. Technological advancements have driven the emergence of digital bank guarantees as a more efficient, transparent, and secure solution. However, regulations regarding digital bank guarantees in Indonesia—including Financial Services Authority Regulation No. 26 of 2024—have not yet comprehensively addressed their mechanisms and governance. This study aims to analyze the legal protection afforded to banks as guarantors in the implementation of digital bank guarantees and to formulate a regulatory framework. The study employs a normative legal method using legislative and conceptual approaches. The results indicate that legal protection for banks still lacks legal certainty due to the absence of uniform standards regarding the issuance, verification, authentication, and supervision of digital bank guarantees. Therefore, regulatory updates are needed to establish national standards for digital bank guarantees, the use of certified electronic signatures, integrated electronic verification systems, and the utilization of technologies such as blockchain to enhance security, transparency, accountability, and legal certainty for all parties involved in business transactions.
