Abstract
Outsourcing practices in the electricity sector still raise issues regarding the boundaries between core business and non-core business despite the issuance of Minister of Manpower Regulation Number 7 of 2026 concerning Outsourcing Work. This study aims to analyze the legal ambiguity in determining the boundaries of core business in the electricity sector based on technical regulations regarding outsourcing work and examine its implementation through a case study of outsourcing at PT PLN (Persero). This study is a normative juridical study with a statutory, case, and conceptual approach analyzed using Gustav Radbruch's theory of three legal objectives. The results show that Minister of Manpower Regulation Number 7 of 2026 has not provided general indicators regarding supporting work and has not systematically linked it to sectoral regulations, thus creating a wide scope for interpretation. Outsourcing practices at PT PLN (Persero) also show that the separation of core business and non-core business is more based on control and implementation functions so that a number of jobs directly related to the provision of electricity are still outsourced. Therefore, it is necessary to refine Ministerial Regulation No. 7 of 2026, revise Government Regulation No. 62 of 2012, and develop job classification parameters based on functional continuity, relevance to public services, and technical safety risks.
