Abstract

This research examines Judicial Inconsistency in Interpreting Legal Norms Related to State Financial Losses in Corruption Crimes. The element of state financial loss plays a fundamental role in establishing the elements of Articles 2 and 3 of Law No. 31 of 1999 as amended by Law No. 20 of 2001 on the Eradication of Corruption. However, judicial practice reveals significant variations in interpretation among judges regarding the boundaries of financial loss, whether actual, potential, or linked to economic loss or environmental damage. These inconsistencies are evident in several court decisions with similar factual patterns but divergent legal considerations, such as the Surya Darmadi and Harvey Moeis cases. The objective of this study is to identify the forms of judicial inconsistency, analyze their underlying causes, and evaluate their implications for legal certainty, fairness, and the effectiveness of corruption eradication. This research employs a normative juridical method using statutory, case, and conceptual approaches. Data were obtained through the analysis of court decisions, statutory regulations, and relevant academic literature. The findings reveal that inconsistent judicial interpretation generates legal uncertainty, sentencing disparity, potential unequal treatment, and diminished public trust in judicial institutions. The novelty of this research lies in providing a comprehensive mapping of interpretative variations regarding state financial loss in natural resource–related corruption cases and proposing the formulation of interpretive guidelines by the Supreme Court through a Circular Letter or Supreme Court Regulation to ensure consistent judicial interpretation. This research contributes to the harmonization of law enforcement practices and the strengthening of judicial integrity in Indonesia.
