Abstract

Law Number 12 of 2022 concerning the Crime of Sexual Violence introduces a new paradigm in the victim recovery system, which is no longer solely focused on the judicial process but also encompasses comprehensive and sustainable recovery, one of which is through economic empowerment. This study aims to analyze the implementation of economic empowerment as a form of post-trial recovery and to examine its correlation with restitution for victims of sexual violence crimes. The issues addressed in this study are the criteria for recipients of economic empowerment and the relationship between economic empowerment and restitution within the framework of victim recovery. This research employs a normative juridical method with statutory and conceptual approaches. The results indicate that the implementation of economic empowerment has not been optimal due to the absence of clear technical regulations regarding beneficiary criteria and the lack of coordination among relevant institutions. Furthermore, economic empowerment and restitution are still implemented separately, resulting in suboptimal recovery for victims. Therefore, it is necessary to strengthen regulatory frameworks and integrate policies to ensure effective, comprehensive, and sustainable victim recovery.
