Abstract

This study examines the application of national law in the 2025 police raid on a gay party in South Jakarta and analyzes the influence of public opinion on the law enforcement process. The absence of clear legal provisions regarding same-sex conduct has led law enforcement officers to broadly interpret morality and pornography articles, creating legal uncertainty and potential violations of the principle of legality. This research employs a normative juridical method supported by a socio-legal approach through media analysis and preliminary interviews. The findings show that the application of relevant criminal provisions is shaped by both normative gaps and social pressure reflected in media coverage and public responses. The study concludes that the combination of legal interpretation by law enforcement officers and prevailing public opinion plays a significant role in shaping enforcement actions. Therefore, careful implementation of the New Criminal Code and clear technical guidelines are needed to ensure that law enforcement remains objective and respects citizens’ constitutional rights.
